1. The Promoter of this competition is Ongame Network Limited (company reg. nr. 89063), of Europort, Suite 611, Gibraltar (hereinafter referred to as "Promoter"). All queries regarding the Poker Race Trophy should be directed to support@pokerroom.com

2. Only persons over the age of 18 are eligible to participate in the Poker Race Trophy (hereinafter referred to as "Participant" or "Entrant"). Employees of the Promoter and its parent, subsidiary and sister companies, persons with prior criminal convictions (or who obtain such during the course of the competition), or who are addicted to gaming or at risk of being addicted to gaming, are not eligible to participate.

3. The Poker Race Trophy commences on 1 February 2008 and concludes on 29 November 2008.

4. Registration is only possible between 1 February 2008 and 11 September 2008 at PokerRoom.com.

5. Participation in the Poker Race Trophy is for free.

6. Each person entering this competition (each "Participant" or "Entrant"), confirms that the personal details stored in their PokerRoom.com account are correct and complete and that the person named in their account is the person who will participate in this tournament. Entrants acknowledge that any changes or discrepancies in this information could lead to disqualification from the tournament and loss of all due winnings.

7. To enter, Participants must take part in one Freeroll Texas Hold’em No-limit poker tournament (each an Online Qualification Tournament) during the period 1 February 2008 to 11 September 2008.

7a. The winner of each Online Qualification Tournament will win the opportunity to compete in the Online Qualification Final for the relevant period.

7b. The winner of each Online Qualification Final will win the opportunity to compete in one of six Poker Race Trophy Offline Semi Finals, together with economy class transfers from the Entrant’s nearest major airport to the relevant Semifinal and back, and three nights accommodation during the Semifinal.. The semi-finals will be held as follows:

• Semi final 1 Curitiba 01/03/2008
• Semi final 2 Valencia 17/05/2008
• Semi final 3 Brno 14/06/2008
• Semi final 4 Brands Hatch 26/07/2008
• Semi final 5 Oschersleben 30/08/2008
• Semi final 6 Monza 04/10/2008

7c. The winner of each Poker Race Trophy Offline Semifinal will win the opportunity to compete in the Offline Grand Final in Vienna on 29 November 2008, together with economy class transfers from the Entrant’s nearest major airport to the Grand Final and back, and two nights accommodation during the Grand Final.

7d. The 6 Participants in the Offline Grand Final will play for total prizemoney of USD500,000.00, to be distributed as follows:

• 1st Place - US$285,000.00
• 2nd Place - US$100,000.00
• 3rd Place - US$50,000.00
• 4th Place - US$35,000.00
• 5th Place - US$20,000.00
• 6th Place - US$10,000.00

8. Each Participant is solely responsible for their own compliance with entry requirements for countries to which they travel as part of the Poker Race Trophy, including without limitation visa and vaccination requirements, and should inform themselves of such requirements in advance. Notwithstanding this, Participants are reminded that they must be in possession of a valid passport, and if required a valid visa and/or vaccination certificate, in order to be eligible to travel to the relevant Poker Race Trophy locations. In particular, Participants should note that yellow fever vaccinations may be required for entry to Brazil (the location of the first Semifinal). The Promoter reserves the right to refuse further participation in the Poker Race Trophy (including without limitation a Semifinal or Final for which the Participant would otherwise have qualified) if a Participant fails to comply with its obligations under this clause.

9. Each Participant is also solely responsible for all other ancillary costs which they incur in participating in the Poker Race Trophy, including transport to and from departure point, meals, spending money and other incidental expenses.

10. Winners of the various stages will be notified by e-mail or by telephone. Only the winner of each Offline Semi final goes to the $500.000 Offline Final in Vienna on the 29th of November 2008. If a winner does not respond as described in the notification e-mail or telephone call, the Promoter reserves the right to disqualify them, and award the prize to the second placed Entrant in the relevant stage.

11. Each Participant in the Offline Semi Final and Grand Final will be obliged to confirm their identity with a valid passport and official residency document before the relevant event begins. If this documentation cannot be produced, Poker Room reserves the right to refuse participation in the relevant and the remainder of the Poker Race Trophy.

12. By participating in the Poker Race Trophy, Entrants give their express permission for their name, image, voice, biographical information and participation in (including any musical compositions they create while participating) the Poker Race Trophy to be filmed, recorded, broadcast, reused and licensed at the Promoter’s discretion (including without limitation to and by third parties) in any media, worldwide, without further notice or compensation to the Entrant, for the purposes of promoting, advertising, selling, publishing and commercialising the Poker Race Trophy and the footage thereof (including any programme created from it).

13. Each Participant further agrees that the Promoter may use their name, image, voice, biographical information and participation in the Poker Race Trophy for accessory products (eg merchandising) in connection with the Poker Race Trophy and any programme created from it, and license the use of such to third parties.

14. Participants agree not to wear any branding of any company other than the Promoter while participating in the Semi Finals and Grand Final (should they be eligible to compete in such).

15. Each Participant guarantees the Promoter and its service providers exclusivity in respect of use of their name, image, voice and participation in similar fun poker tournaments, and that they will not confer any contractual rights to a direct competitor of the Promoter until the end of the competition, or the end of their participation in it, except with the prior written consent of the Promoter.

16. Participants must not make any press releases or other publications concerning their participation in the Poker Race Trophy without the prior written consent of the Promoter.

17. Without limiting their obligations under clause 6, each Participant warrants that any statements which they make during their participation in the Poker Race Trophy are true to the best of their knowledge. Further, each Participant warrants that neither their participation in the Poker Race Trophy, or any statements they make while participating, will be illegal, defamatory or in breach of any third party rights, including without limitation intellectual property rights.

18. No cash redemption (other than the Grand Final prize) or alternate prize is possible, however the Promoter reserves the right to provide substitute prizes of a similar value should the specified prizes become unavailable.

19. By recognising these terms and conditions, Entrants give their express permission for the Promoter to send them messages (text messages, E-Mails) for advertising purposes.

20. No responsibility is taken for the correctness of this information. All information is subject to change. The Promoter reserves the right to suspend, terminate, amend, vary or modify these Terms and Conditions prior to the closing date by giving notice on PokerRoom.com.

21. The Promoter reserves the right in its absolute discretion to disqualify entries which he considers do not comply with these Terms and Conditions, or any Entrant who the Promoter reasonably believe has interfered with the fair running of, unfairly benefited from interference with the fair running of, or committed any fraudulent actions in relation to, the Poker Race Trophy and/or the results of it. The Promoter reserves the right to undertake all such action as is reasonable to protect itself and its service providers against fraudulent or invalid conduct in relation to the Poker Race Trophy.

22 The Promoter, its service providers (including without limitation venue operators and broadcasters), officers, employees and agents will not be liable for:

• A. Any loss or damage whatsoever suffered or sustained in connection with the Poker Race Trophy Competition or the use of any prize, save that the Promoter does not exclude our liability for fraudulent misrepresentation or for death or personal injury caused by its negligence; or

• B. Any act, omission, event or circumstance which occurs due to war, earthquake, catastrophe, strike or any other event beyond our reasonable control.

23. For all other instances, the General Terms and Conditions available at PokerRoom.com apply.

24. The Poker Race Trophy competition is governed by the laws of Gibraltar. Any dispute arising under these terms of use shall be subject to the exclusive jurisdiction of the Gibraltar courts.
